1. General Information and Definitions

ACG Advogados created this Privacy Policy to demonstrate its commitment to protecting privacy and personal data, pursuant to the General Data Protection Law and in accordance with other laws on the matter, as well as to describe how privacy is protected by ACG Advogados when collecting, processing and storing personal information.

2. Purpose of Use of Personal Information

ACG Advogados processes personal data as necessary for the performance of an agreement or preliminary procedures related to an agreement to which the data subject is a party. ACG Advogados may also process data in the regular exercise of rights in judicial, administrative or arbitration proceedings.

3. Sharing and Processing Personal Information

ACG Advogados will not provide Personal Data in its possession to mailing list brokers without the express consent from the data subject.

ACG Advogados may disclose Personal Data to third parties, in the following events and within the limits required and authorized by the Law:

  2. With companies and individuals hired to perform certain activities and services for ACG Advogados;

In the event of sharing Personal Data with third parties, all subjects mentioned in items I to V must use the shared Personal Data consistently and in accordance with the purposes for which they were collected (or to which the data subject previously consented) and as determined by this Privacy Policy, other privacy statements of websites or countries, and all applicable privacy and data protection laws.

4. Legal Reasons for the Disclosure of your Data

Under certain circumstances, ACG Advogados may disclose Personal Data, to the extent necessary or appropriate, to government agencies, consultants and other third parties in order to comply with applicable law or with a court order or subpoena, or if ACG Advogados believes in good faith that such action is necessary to:

  • Performance of its agreements;

  • In case of sale, purchase, consolidation, restructuring, liquidation or dissolution of ACG Advogados.

5. Security of Personal Information

All Personal Data will be protected by cloud data systems maintained by ACG Advogados and/or engaged service providers, which are duly in accordance with data laws in force.

ACG Advogados and its suppliers use several security procedures to protect the confidentiality, security and integrity of Personal Data, preventing any possible damage due to the processing of such data.

Although ACG Advogados uses security measures and monitors its system to check for vulnerabilities and attacks to protect Personal Data against unauthorized disclosure, misuse or modification, the data subject understands that there are no guarantees that the information will not be accessible, disclosed, modified or destroyed due to breach of any of the physical, technical or administrative protections.

6. Data Retention

ACG Advogados retains all data provided, including Personal Data, for as long as necessary to carry out its services.

ACG Advogados may retain Personal Data for an indefinite period of time, even if it receives a request for deletion, if this is necessary to comply with legal obligations, resolve disputes, maintain security, prevent fraud and abuse and ensure compliance with agreements.

7. Right to Access and Control Personal Data

ACG Advogados offers the data subject several options on what to do with their Personal Data collected, processed and stored, including its deletion and/or correction:

  • Delete data: the data subject may request the deletion of some of their Personal Data (for example, if they are no longer needed to provide them with the services).
  • Modify or correct data: the data subject may edit or request the editing of some of their Personal Data, may also request updates, changes or corrections to their data in certain cases, especially if they are incorrect.
  • Establish objections, limits or restrictions on the use of data: the data subject may request the cessation of the use of all or some of their Personal Data (for example, if we do not have the right to continue using them), or limit our use of such data (for example, if their Data Personal data are incorrect or illegally stored), highlighting that ACG Advogados may process Personal Data in accordance with the legal grounds.
  • Access or take your data: the data subject may request a copy of their Personal Data and the data they have provided in a readable format in hard or soft copy.
